游客的生态权利和生态义务刍议

摘 要: 随着旅游业的发展, 旅游对生态环境的负面影响日益严重.为了拯救正在不断退化的生态系 统, 必须使游客认清他们在旅游过程中所享有的生态权利和必须履行的生态义务.首先从游客的生 态权利和生态义务的概念出发 , 具体阐述了游客应 享 有 的 生 态 权 利 和 必 须 履 行 的 生 态 义 务 , 概 括 了 保证游客享有生态权利和履行生态义务 应 采 取 的 有 效 措 施 .游 客 的 生 态 权 力 和 生 态 义 务 是 相 辅 相 成, 彼此制约的统一体.没有随意支配的权利, 也没有脱离权利的义务 . 关键词: 游客; 生态权利; 生态义务 中图分类号: F592.0 文献标识码: A
Ecological Rights and Ecological Obligation of the Tour ists e, Du Jin' Zhou Qing, Zhang Guangsheng

Abstr act: Along with the development of tourism, the negative influence of it to the eco- environment is increasingly serious. In order to protect the unceasing degraded eco- system, we must make sure that the tourists recognize the ecological rights they can enjoy and the ecological obligation they must perform when they enjoy what the nature gives them. After clarifying the concept of ecological rights and ecological obli- gation, ecological rights and ecological obligation of the tourists were expounded concretely and the effec- tive steps to guarantee the ecological rights they can enjoy and the ecological obligation they should fulfill were summarized. Because there are no optionally dominant rights and no obligation which is divorced from rights, so ecological rights and ecological obligation is a complete unit or entity which supplements and re- stricts each other. 1 前言 旅游对生态环境的负面影响越来越多的引起政府 与民众的关注,生态旅游作为协调旅游与环境矛盾的 模式应运而生.遗憾的是作为生态旅游主体的游客生 态观念缺失, 远未达到遏止生态环境退化的趋势. 报告 [1] 显示 , 中国目前有 44%的自然保护区存在垃圾公害, 12%出现水污染, 11%有噪音污染, 3%有空气污染. 与众多学者对生态旅游涵义, 生态旅游产品构成, 生态旅游规划原则和方法,生态旅游实施措施以及生 态旅游对自然保护区的战略意义等研究相比,有关游 客生态权利和生态义务的研究尚不多见. 鉴于在 生态 " 旅游系统" 中游客是该系统的主体[2], 游客意识与行为 在一定程度上决定了该体系的发展方向.探讨游客的 生态权利和生态义务以及落实上述权力与义务的措施 显得尤为重要,抑或是生态旅游健康可持续发展的关 键因素之一. 2 游客的生态权利 2.1 生态权利的概念 《 俄罗斯联邦宪法》 对生态权利做出了明确规定, 属于宪法性的 人和公民的生态权利" " 主要有: 享受良 好环境的权利; 获得关于环境状况的可靠信息的权利; 要求赔偿因生态破坏所导致的公民健康损害和财产的
